1.0 General Terms & Conditions

1.1 Welcome to Premier Furniture (B’ham) Ltd’s General Terms & Conditions. This page explains the terms and conditions for purchases from Premier Furniture (B’ham) Ltd. By using this website, placing any order(s) and or using any service that we provide, you agree to be legally bound by these terms and conditions.

1.2 Premier Furniture (B’ham) Ltd (“Premier Furniture”, “we”, or “us”) reserves the right to change these Terms & Conditions periodically without notice to you and any changes will take effect on the day they are posted. Any such changes will be posted in this section of the website and your continued use of the website constitutes your agreement to be bound by the prevailing Terms & Conditions. You are encouraged to read these Terms & Conditions carefully.

2.0 Ordering & Availability

2.1 To place an order with us you must be over the age of 18 years.

2.2 If you have chosen to pay by card, once your order is received we will process the payment for your order by way of the credit or debit card details you have provided to us. As soon as we receive notification from our online system or by the next working day, we shall send you out a personal email stating the particulars of the order. This will then be followed by a telephone call from us to confirm that all the order details are correct and to ensure that we can be of maximum assistance to you. This will also provide you with the opportunity to settle any queries you may have regarding your order. Once we are both satisfied with the order, arrangements will be made to deliver or to prepare delivery of your order.

2.3 If we have your order in stock or if your order is in stock with our supplier, we aim to have it with you within 7 - 14 working days of the time of your order (48 hours if you live within the West Midlands). If your order is out of stock with our supplier or if we are tailoring the order to your specific requirements, we aim to have it with you within 6 - 12 weeks. We will inform you of an estimated delivery time at the time of order. If for any other reason beyond our control we are unable to supply a particular item, we will inform you as soon as possible but we will not be liable to you except to ensure that you are not charged for that item.

4.0 Descriptions, Prices and Product Information

4.1 All product information which includes images and dimensions has been obtained by the product manufacturers. We endeavour to ensure that all information is as up to date and as accurate as possible. However, on occasions an error can occur and we suggest that you visit the manufacturers’ web site for full detailed specification. All accessories supplied with a product are subject to change or upgrade at the manufacturer’s discretion. We will supply the product as supplied to us by the manufacturer.

4.2 All prices and charges on this website are quoted in UK pounds. The price you pay for your order is that price which is displayed on the website. Prices include VAT unless otherwise stated. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you an option of reconfirming your order at the correct price, or cancelling the order. If we are unable to contact you we will treat the order as cancelled and you will receive a full refund.

5.0 Payment and Acceptance

5.1 If you buy an item from Premier Furniture (B’ham) Ltd on the phone, in-store or online you will be charged for an item at the time you place your order. After this time, if you wish to cancel or amend your order, please contact us by using the contact information provided.

5.2 Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually despatch an item to you, at which point a contract will be made between us. At any point up until then we may decline to supply an item to you. If we decline to supply an item to you and you have already paid for it, we will give you a full refund of any amount already paid for. For further details, please see Para. 9.0.

5.3 All credit and debit card payments that are made on our website are protected by a secure connection. This secure connection ensures that your credit and debit card is encrypted prior to it being transferred to the bank for authorization. As an additional security measure, no credit or debit card details submitted online are stored directly by us once your order has been processed.

6.0 Payments

6.1 If you wish to pay by cash, you can do this but only in store. Paying for your order on-line can be done with the following cards:

* Visa
* Visa (Debit)
* Visa (Electron)
* Solo
* All business, commercial & corporate cards (credit/debit).

6.2 Authority for payment must be given at the time of order. If there is a problem taking payment for your order we will contact you by email or by telephone.

7.0 Delivery

7.1 We use a variety of delivery methods, depending on the size of your order and the location to which it is to be delivered. Some items are delivered directly by the supplier, in which case we will inform you of this and the supplier will contact you to arrange delivery.

7.2 After you place your order with us, we will contact you to provide you with an idea of when the order can be delivered to you. However, due to occasional circumstances beyond our control, we may not be able to deliver the product within the arranged time, in which case we will inform you as soon as possible to notify you of this.

7.3 Delivery will be made to the address specified when you complete the order. Alternatively, you may choose to collect your items from our Store. Please inform us as soon as possible if you are intending to do this. Please note we only deliver to addresses within England, Scotland and Wales. Free delivery to addresses within mainland GB, except to PH, PA, IV, KW and AB postcodes where there will be a small additional charge which will be advised prior to delivery. It is your responsibility to ensure the item(s) you have ordered will pass through all access points in your home. Once delivery has been made to your door you will be responsible for them. A signature is required on delivery. By placing an order with us, you are authorising us to accept a signature from another person on your behalf at your delivery address if you are not present at the time of delivery. Under exceptional circumstances, you may be able to give instruction explaining if and where you would like your order to be left if no one is expected to be present at the time of delivery, such as with a neighbour.

7.4 You must inspect your goods and make a note on the delivery document if there are any shortages or damages. If there are, please make sure that you inform the delivery person, who will make a note on the delivery document. If however, you notice that the product is damaged after delivery has been made, you must contact us immediately and certainly within 48 hours of the delivery being made.

7.5 Title of the product will pass to you once you have received the goods and we have received full and cleared payment. Risk of damage or loss of the item then passes to you. Where a delivery date has been agreed with our carrier but the customer isn't present to receive the delivery we reserve the right to charge the customer a minimum of £25 to cover part of the cost of that failed delivery.

8.0 Cancellation of Order

8.1 If you order a product from us you do have the right to cancel your order as long as this is done before the point of delivery. We will be happy to provide you with a full refund when we have cancelled your order and certainly within 30 days of notification.

8.2 If your order has not been dispatched we will cancel the order and we will refund your payment. If your order has been dispatched to you and we are unable to stop the delivery, you can refuse to sign for the delivery so that your order is returned to us and we will refund your payment in full.

8.3 We also reserve the right to refuse to accept your request for order if for any reason:

· We have insufficient stock to deliver the goods you have ordered; Mattresses or divans (unless still fully packaged);

· The product (s) you have ordered are no longer available;

· Your order or part of your order was incorrectly described or priced on our website; or

· The payment transaction was not authorised.

8.4 If we do cancel your contract we will notify you as soon as possible and we will refund to you any sum paid by you to us in respect of the contract within 30 days of the cancellation of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

9.0 Refund Policy

9.1 At Premier Furniture (B’ham) Ltd, we are happy to provide a refund if for some reason you are not fully satisfied with your products. However, this must be done within ten days of receipt of the order. You can either arrange to return the goods to us at your own cost or we can arrange re-collection of the order for a minimum fee of £25, this charge would be deducted from your refund. You have a duty of care to ensure that items are not damaged while in your possession and all goods must be returned to us in the same condition they were in when they were delivered. We would also ask that they be returned with their original packaging or similar to avoid damage on their return journey. We reserve the right to withhold all or part of your refund if items are returned damaged. We will then provide you with a refund within 30 days of recollection of your order. However, in this case all relevant delivery charges will apply. If after reasonable attempts to collect your order have been made but you have not been present, you will be deemed to have accepted your order, at which point a new purchase contract will be made and you will be charged for your order at the most recent price. This does not affect your statutory rights. In this case, all delivery charges will apply.

9.2 All our products are covered by a one-year Manufacturer’s warranty. Unfortunately, no refunds are available on the following items:

· Mattresses or divans (unless still fully packaged);

· Sales or clearance items;

· Items which have been assembled or which have been attempted to have been assembled;

· Tailor-made or bespoke orders.

9.3 Of course, if the product is faulty then we will be happy to provide you with a full refund

10.0 Refund of Faulty Items

10.1 If you have any problems with your purchase we will be happy to offer help and assistance.

10.2 If you inform us that your product is faulty and we accept this, we can arrange for an exchange or for the item to be repaired with no extra cost to you. You will be required to send a copy of the invoice which accompanied delivery. Failure to show that you have purchased the item from us may result in the refusal of exchange or in the repair becoming chargeable. (If a repair is chargeable, we will tell you in advance.)

10.3 Exchange is dependant on our stock and repair turnaround time is dependant on the relevant manufacturer's current workload. We will not accept any claims for losses you suffer during this time.

10.4 If a fault is caused by accident, misuse or negligence, it will not be covered by the manufacturer's warranty. Service estimates for an item not covered by the manufacturer's warranty will be chargeable.

11.0 Unforeseen Circumstances

11.1 While every effort is made to meet our customers’ demands, cancellations or variations may be necessary as a result beyond our control.

12.0 Our Responsibility

12.1 If we are in breach of these Terms & Conditions, we will be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order. Our products are for personal use only and our liability shall not in any event include business losses such as lost profits or business interruption. Our liability to you in connection with any order will not exceed the total price charged for the items.

13.0 Data Protection and Privacy

13.1 Information you provide to us remains confidential. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998. We collect information about you for two reasons: firstly, to process your order and, secondly, to provide you with the best possible service. You specifically authorise us to transmit information to or to obtain information about you from third parties (including, but not limited to, your debit or credit card number), to authenticate your identity, to validate your debit or credit card and to authorise the transaction. You acknowledge that you consent to the processing of such information. For more detailed information about this please read our full Privacy Policy.

14.0 General

14.1 You may not transfer any of your rights under these Terms & Conditions to any other person. We may transfer our rights under these Terms & Conditions to another business where we reasonably believe your rights will not be affected.

14.2 If you breach these Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms & Conditions.

14.3 We shall not be responsible for any breach of these Terms & Conditions caused by circumstances beyond our reasonable control.

14.4 Except as expressly set out in these Terms & Conditions, all use of your personal information will be made in accordance with our Privacy Policy.

14.5 When ordering from our website we accept orders only from Web browsers that permit communication through our secure systems. This means you cannot inadvertently place an order through an unsecured connection.

14.6 These Terms & Conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way that we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland or Wales.

15.0 Assembly

Customers should be aware that most items require some basic assembly, easy-to-follow instructions are provided with all items. All orders that are being delivered to a Birmingham postcode will include free assembly that will be completed at the time of delivery.
